These Terms of Service (the "Agreement") govern your use of our services, including but not limited to our photography and videography services, digital images, and other related products (the "Services"). Scope of Services We offer photography and videography services for various purposes, including but not limited to competition, engagements, corporate events, and personal projects. Our Services may include digital images, prints, albums, and other related products.
1) Booking and Payment To book our Services, you must pay a deposit or the full amount upfront, as specified in our pricing and payment terms. The deposit is non-refundable, and failure to pay the balance by the specified date may result in the cancellation of your booking. We accept payment by credit card, debit card, or bank transfer.
2) Cancellation and Rescheduling: If you need to cancel or reschedule your booking, please contact us as soon as possible. We understand that unforeseen circumstances may arise, and we will work with you to find a solution. However, please note that if you cancel your booking, your deposit is non-refundable. The service will then be moved to the backup date, Note that if the client cancels both dates there is NO guarantee that the next date will be scheduled within a timely manner
3) Intellectual Property: We retain the copyright and all other intellectual property rights in the digital images, prints, and other products we provide as part of our Services. You may not reproduce, distribute, or use any of our images or products without our prior written consent. However, we grant you a non-exclusive, non-transferable license to use the images and products for personal or commercial use, subject to the terms of this Agreement.
4) Copyright Ownership and Transfer of Use Rights: Unless otherwise agreed in writing, we retain the copyright and ownership of all images and products we provide as part of our Services. However, we grant you a license to use the images and products for personal or commercial use, subject to the terms of this Agreement. You may not sell, transfer, or assign the license or any of your rights under this Agreement without our prior written consent.
5) Post-Production and Editing: We reserve the right to edit and post-produce all images and videos as we see fit, in accordance with our artistic style and vision. We will not provide unedited raw files or footage to clients. However, we will make every effort to accommodate any reasonable requests for edits or revisions, subject to our sole discretion. You are also responsible for obtaining any necessary permits, licenses, or other authorizations required for us to perform our Services. You may not edit, modify, or alter any of the images, videos, or other products we provide as part of our Services, without our prior written consent. Any unauthorized editing or alteration of our Services may result in a breach of this Agreement and may subject you to legal action.
Liability We take great care in providing our Services, but we cannot be held liable for any damage, loss, or injury that may occur during or as a result of our Services. You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our Services.
7) Termination: We reserve the right to terminate this Agreement and our Services at any time and for any reason. In such cases, we will refund any payments made for Services not yet rendered.
Governing Law and Dispute Resolution This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which we are located. Any dispute arising out of or relating to this Agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.
Changes to this Agreement We reserve the right to modify this Agreement at any time by posting a revised version on our website. Your continued use of our Services after any such changes constitute your acceptance of the revised Agreement.
8) Entire Agreement This Agreement constitutes the entire agreement between you and [business name] with respect to the use of our Services and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
